Jupiter woman sues apartment complex over 2012 abduction, assault
A Jupiter woman has sued the owners and managers of Wood Duck Apartments, claiming she wouldn’t have been abducted and sexually assaulted in March 2012 if they had provided adequate security.
The abduction of the woman, who is not being named because of the nature of the attack, marked the beginning of a violent hours-long crime spree that also found customers at a Denny’s and International House of Pancakes being robbed at gunpoint.
In the lawsuit filed this week in Palm Beach County Circuit Court, the woman accuses the apartment owners and managers of negligence. Had they provided lighting, properly trained security guards and taken other steps to secure the complex on Military Trail, near Tonney Pena Drive, Benjamin Goldwire and Carlton Thomas wouldn’t have been able to grab her and steal her car, according to the lawsuit filed by Coral Gables attorney Douglas McCarron.
She is making similar claims of inadqueate security against the estate of J.K. Herd, who owned an abandoned house in Riviera Beach where the two men took her. The woman, then 20, was duct-taped and sexually assaulted at the house, police said.
Goldwire, 23, and Thomas, 25, both of Riviera Beach were convicted in November of car-jacking, kidnapping, aggravated assault and six counts of robbery with a firearm after a two-week jury trial. Goldwire was sentenced to life in prison while Thomas was handed a 25-year term. While Goldwire was to be tried for sexual assault in connection with the attack, that charge was dropped after the trial. Both are appealing their convictions.
After leaving the woman at the Riviera Beach house, Goldwire and Thomas traveled south. They stopped first at a Denny’s on Okeechobee Boulevard in West Palm Beach where they used an AK-47 and a revolver to rob restaurant customers, prosecutors said. They then drove to an IHOP on South Dixie Highway in Lantana and robbed customers there. They were eventually arrested at a Best Western Motel in Port St. Lucie.
